Workshop & Coaching Conditions of participation
§ 1 Scope of application
1. the following provisions are binding for all forms of personal participation in workshops, coaching sessions and events organized by Arne Claußen and as such are a direct component of the respective contractual relationship between Arne Claußen (hereinafter referred to as "AC") and the individual participants.
2. participants in this sense are all photographers, models, make-up artists, stylists and any other person who is on the set in agreement with AC.
§ 2 Participation
1 Participation and travel to and from the event shall be at the participant's own expense, unless otherwise expressly agreed between the individual parties. Necessary expenses will not be reimbursed.
2. each participant must arrive at the venue punctually at the start of the event.
3. the instructions of AC or its vicarious agents (officials) must be followed unconditionally for the entire duration of the event.
§ 3 Registration / Cancellation
1. registration for the workshop must be made exclusively in writing by e-mail to hallo@arneclaussen.de or via the respective workshop form at www.arneclaussen.de or via the GetResponse platform. Payment of the participation fee is due immediately.
2. if the workshop or event is canceled by the participant - for whatever reason - there is no entitlement to a refund of the participation fee. AC will, however, endeavor to find a replacement participant. If the participant does not show up, there is no entitlement to a refund.
2. if the coaching / individual coaching is canceled by the participant - for whatever reason - the following participation fees will be refunded:
Cancellation up to 30 calendar days before the start of coaching: 50%
Cancellation up to 14 calendar days before the start of coaching: 30%
Cancellation up to 7 calendar days before the start of coaching: 10%
In the event of cancellation within 7 calendar days before the start of the coaching or non-appearance of the participant, there is no entitlement to reimbursement of the participation fee
§ 4 Rights of use
1. the models each receive the irrevocable right to use the images provided to them by the photographer on a voluntary basis for self-promotional purposes (sedcard, website, model portfolio, social media channels) for an unlimited period of time.
2. if photos show participants other than the participating model, care must be taken to ensure that images may not be published or distributed without the consent of all persons depicted in them. Furthermore, care must be taken to ensure that non-accredited persons are generally not photographed.
§ 5 Making Of photos/videos
1. AC shall have video and/or photographic material made of the workshop as such at its own discretion, on which the participants will also be seen. The participants agree to this.
2 Each participant permits AC to use the image and film material created for documentation and self-promotional purposes on the Internet or in other media. Consent is irrevocable and is generally valid for an unlimited period. However, it shall only apply insofar as the publication does not violate any legitimate interest of the person depicted, e.g. the depiction in a disfiguring or compromising manner.
§ 6 Liability
1 AC accepts no liability for damage suffered by participants on arrival or departure, nor for items lost during the event.
2 AC shall only be liable for material damage if this is caused by intentional or grossly negligent breaches of duty by AC or its vicarious agents.
3 AC shall not be liable for personal injury or damage to property of any kind incurred by the participant due to intentional or grossly negligent misconduct on the part of other participants. Furthermore, AC shall only be liable for damage caused by individual participants insofar as AC or its vicarious agents are guilty of independent contributory negligence. In particular, AC shall not be liable as a mere disturber of conditions, an initiator of the purpose or from the liability concept of responsibility for rooms. As the events are designed to work together with an indefinite number of changing participants, the assumption that AC is at fault for the selection of the participants is also generally out of the question.
4 AC assumes no guarantee for the reliability of the individual participants and is in particular not liable for their professional or personal suitability.
5 AC shall not be liable for the unauthorized publication, distribution or other copyright infringements committed by individual participants or by means of photos taken by them during photo shoots or otherwise to the detriment of other participants.
6. the above exclusions of liability shall only apply insofar as they do not conflict with mandatory statutory provisions.
§ 7 Warning / exclusion
1. the instructions of AC and / or its vicarious agents must be followed at all times. If a participant violates workshop rules or instructions, he/she may be warned and, in the event of a repeat offense, excluded from the event.
2 AC reserves the right to exclude participants from the workshop without prior warning in the event of continued or particularly gross violations.
3. excluded participants remain obliged to pay the full participation fee.
§ 8 Cancellation of the event
If the event is canceled (due to illness of AC or under-occupancy of the workshop), participants will be reimbursed the participation fees paid without delay. Participants are not entitled to any further reimbursement.
§ 9 Final provisions
1. deviating GTC shall not become part of the contract. Deviating individual agreements shall only be effective if they have been expressly agreed with an organ of AC. Officials are not authorized to agree deviating terms and conditions.
2. if individual provisions of these GTC are invalid, this shall not affect the validity of the remaining provisions. In this case, the parties undertake to include an appropriate, effective replacement provision.
3. the place of jurisdiction for all disputes arising from the respective event contractual relationship is Böblingen.
